  • Imran Khan’s indictment in Toshakhana reference deferred yet again

    اسلام آباد کی ایک ڈسٹرکٹ اینڈ سیشن عدالت نے منگل کو پی ٹی آئی کے چیئرمین عمران خان پر توشہ خانہ ریفرنس میں فرد جرم طبی بنیادوں پر موخر کر دی کیونکہ جج نے ریمارکس دیئے کہ اگر یہ تاخیر جاری رہی تو ان کا ٹرائل غیر معینہ مدت تک جاری رہے گا۔

    ایڈیشنل ڈسٹرکٹ اینڈ سیشن جج (اے ڈی ایس جے) ظفر اقبال نے عمران کو 28 فروری کو ذاتی طور پر عدالت میں پیش ہونے کی ہدایت کی ہے۔

    31 جنوری کو عدالت نے… اعلان کیا پی ٹی آئی کے سربراہ کے خلاف الزامات – جو گولی لگنے کے بعد زخمی ہونے کے بعد صحت یاب ہو رہے ہیں قتل کی کوشش 3 نومبر کو ریلی کے دوران – 7 فروری کو ریفرنس میں ہوگا۔

    تاہم گزشتہ سماعت میں عمران کے وکلا نے درخواست دائر کی تھی۔ استثنیٰ کی درخواست عدالت میں ذاتی طور پر پیشی کے لیے، جس کے بعد سابق وزیراعظم پر فرد جرم آج تک موخر کر دی گئی۔

    اس کے بعد ای سی پی نے قریب پہنچا اسلام آباد کی سیشن عدالت نے ریفرنس کی ایک کاپی کے ساتھ عمران کے خلاف فوجداری کارروائی کی درخواست کی ہے کہ وہ بطور وزیر اعظم اپنے دور میں غیر ملکی معززین سے ملنے والے تحائف کے بارے میں مبینہ طور پر حکام کو گمراہ کر رہے ہیں۔

    عمران نے خواجہ حارث احمد، بیرسٹر سید علی ظفر، بیرسٹر گوہر علی خان اور ایڈووکیٹ علی بخاری پر مشتمل سینئر وکلاء کی ٹیم کو اس کیس میں ای سی پی کی شکایت کا مقابلہ کرنے کے لیے شامل کیا ہے۔

    سماعت

    آج سماعت کے آغاز پر پی ٹی آئی سربراہ کے وکیل نے عدالت میں استثنیٰ کی ایک اور درخواست دائر کی۔ ایڈووکیٹ گوہر نے کہا کہ عمران خان کا ایکسرے 28 فروری کو کیا جائے گا۔

    یہاں، عدالت نے نشاندہی کی کہ اگر یہ (عمران کی غیر حاضری) جاری رہا تو ٹرائل کبھی ختم نہیں ہوگا۔

    ای سی پی کے وکیل نے استثنیٰ کی درخواست پر بھی اعتراض کرتے ہوئے کہا کہ درخواست کے ساتھ میڈیکل سرٹیفکیٹ منسلک نہیں کیا گیا۔

    \”ایک حکم پاس ہونا چاہئے [form] عمران کے لیے ایک میڈیکل بورڈ،\” انہوں نے درخواست کی، انہوں نے مزید کہا کہ پی ٹی آئی کے سربراہ کا طبی معائنہ کرایا جائے۔

    اس پر عدالت نے عمران کے وکیل سے کہا کہ وہ اپنے موکل کا میڈیکو لیگل سرٹیفکیٹ پیش کریں تاکہ ان کے زخموں کی حد کے بارے میں معلوم ہو سکے۔

    سماعت کے ایک موقع پر کیس کے ریکارڈ کی کاپیاں تقسیم کی گئیں۔

    \”قانون کے مطابق، مقدمے کی کاپیاں ملزم کو اس کی موجودگی میں دی جاتی ہیں۔ [in court]. عمران خان کو آج اسی وجہ سے طلب کیا گیا تھا،” اے ڈی ایس جے اقبال نے کہا۔

    انہوں نے یہ بھی پوچھا کہ عدالت میڈیکو لیگل سرٹیفکیٹ کے بغیر عمران کی صحت کا تعین کیسے کر سکتی ہے۔ \”کیوں نہ میڈیکل کروائیں۔ [examination] پمز ہسپتال میں عمران کا\”، جج نے مزید کہا۔

    بعد ازاں سماعت 28 فروری تک ملتوی کر دی گئی کیونکہ عدالت نے عمران کے وکیل کو ہدایت کی کہ وہ اگلی کارروائی میں پی ٹی آئی سربراہ کی حاضری یقینی بنائیں۔

    دریں اثنا، پیر کو لاہور ہائی کورٹ (ایل ایچ سی) نے الیکشن کمیشن آف پاکستان (ای سی پی) کے باہر احتجاج سے متعلق کیس میں عمران کی 3 مارچ تک حفاظتی ضمانت منظور کر لی۔

    جسٹس باقر علی نجفی کی سربراہی میں لاہور ہائیکورٹ کے دو رکنی بنچ نے عمران کی درخواست ضمانت منظور کر لی جب وہ عدالت کے مطالبے کے مطابق ذاتی طور پر پیش ہونے میں کامیاب ہو گئے۔

    اس کے بعد پی ٹی آئی سربراہ دوسرے کیس میں جسٹس طارق سلیم شیخ کی عدالت میں پیش ہوئے۔ عدالت نے ان کی پہلی ضمانت کی درخواست سے متعلق دستاویزات میں تضادات کو نوٹ کیا تھا۔

    پی ٹی آئی سربراہ نے عدالت کو آگاہ کیا کہ وہ اپنی درخواست ضمانت واپس لینا چاہتے ہیں۔ عمران نے اپنی وجہ سے ہونے والی تکلیف پر افسوس کا اظہار کیا اور غیر مشروط معافی کی پیشکش کی۔

    ان کی معافی قبول کرتے ہوئے عدالت نے کیس نمٹا دیا۔
